Participating in a training
program for running is potentially hazardous activity. There are
inherent risks, both foreseeable and unpredictable, associated with any
exercise program. Individuals should not enter and participate in the
Medtronic TC Kids Marathon program unless they are medically able.
Participants, or in the case of children under 18 years of age their
parents or legal guardians acting on their behalf, assume any and all
risks associated with participating in the Medtronic TC Kids Marathon
program, including but not limited to falls, sprains, broken bones,
cuts, torn muscles or ligaments, contact with other participants or
non-participants, the effects of weather including high heat or
humidity, the condition of the roads and the condition of any equipment
they may use.
By downloading Medtronic TC Kids Marathon
program materials or otherwise participating in the Medtronic TC Kids
Marathon program, participants, or in the case of children under 18
years of age their parents or legal guardians acting on their behalf,
verify that their participation is voluntary, acknowledge that they
have full knowledge of the rigors and risk involved in participating in
the Medtronic TC Kids Marathon program and agree that they will consult
their personal physicians independently in the event of any injuries or
medical questions related to their fitness or participation in the
Medtronic TC Kids Marathon program.
In consideration of
participating in the Medtronic TC Kids Marathon program, each
participant, or in the case of a child under 18 years of age a parent
or legal guardian on his or her behalf, hereby for himself or herself,
his or her heirs, executors, administrators and anyone else who might
claim on his or her behalf, covenants not to sue and waives, releases
and discharges any organization associated with the Medtronic TC Kids
Marathon program, and the local governments and police, volunteers and
any and all sponsors, including their agents, employees, assigns or
anyone acting on their behalf, from any and all claims or liability for
death, personal injury or property damage of any kind or nature arising
out of, or in the course of, such participant's participation in the
Medtronic TC Kids Marathon program and all events and activities
associated with the Medtronic TC Kids Marathon program.
This
Release and Waiver extends to all claims of every kind or nature
whatsoever, foreseen or unforeseen, known or unknown. By entering into
the Medtronic TC Kids Marathon program, each participant, or in the
case of a child under 18 years of age his or her parent or legal
guardian acting on his or her behalf, grants permission to Twin Cities
Marathon, Inc. (TCM, Inc.) and agents authorized by it to use any
photographs, videotapes, motion pictures, recordings or any other
record of events related to the Medtronic TC Kids Marathon program for
any purpose without limitation or compensation.
"All users who
use any portion of the Medtronic TC Kids Marathon training program
accessed from this web site must be 18 years of age or older and (a)
must be the parent or legal guardian of all children under 18 years of
age that will participate in the TC Kids Marathon program under such
user's supervision or (b) in the event that such user is not the parent
or legal guardian of any such participant under 18 years of age, must
obtain written agreement to the terms and conditions of this Release
and Waiver from such participant's parent or legal guardian."
